Cultivation of marijuana
On February 2, 2016, the Sacramento City Council adopted Section 17.228.127 of the Sacramento City Code allowing certain non-residential properties to be used for the commercial cultivation of marijuana, with a Conditional Use Permit (CUP). Cultivation, as defined in Title 8 of City of Sacramento City Code means to plant, grow, harvest, dry, cure, grade or trim marijuana. Cultivation must be indoors, within a fully enclosed building and must not be visible from the public right-of-way.
On November 22, 2016, the City Council adopted Ordinance No. 2016-0051 which provided specific regulations for marijuana cultivation businesses. Under the ordinance, cultivation permits may be issued for three different cultivation permit types, namely:
- Class A for indoor cultivation of no more than 5,000 sq. ft. of total canopy size
- Class B for indoor cultivation of no more than 10,000 sq. ft. of total canopy size
- Class C for indoor cultivation sites up to 22,000 sq. ft. of total canopy size
Cultivation will be allowed on a case-by-case basis in the following zones:
- Agricultural (A)
- General Commercial (C2)
- Heavy Commercial (C4)
- Light Industrial (M-1 and M-1S)
- Heavy Industrial (M-2 andM2S)
Terms: $2.00 per sq ft from 10,000 to 22,000 sqft
